Press Release submitted by Tara Henderson, City of Alachua The case filed by the Alachua Leadership Alliance and several individuals against the City of Alachua, Wal-Mart and Waco Properties, which challenges actions of the City relating to growth and the establishment of a Wal-Mart distribution center, was dismissed with prejudice today. City Attorney Marian B. Rush, of the Law Office of Rush and Glassman, argued to the court that the plaintiffs had disobeyed numerous orders of the court and did not abide by the rules governing the lawsuit and, therefore, the case should be dismissed. The Honorable Robert Roundtree, Jr. found that the plaintiffs were simply trying to delay the action by continually filing one amended complaint after another over the past two years. The Court found that after filing four defective complaints, enough was enough, and dismissed the case. I was in attendance at the hearing, and the Court's ruling confirms the City's efforts for planned growth, "This is vindication that the City has always maintained its direction of planned growth, smart growth – growth that is conducive for this community, and will continue to do what is best for this great community of Alachua."
